Minutes of Zoning Board of Appeals Public Meeting

Time: 7:00 PM
Attendees: Trevor Pontbriand, Vern Jacob, Jeffrey Stewart, Bruce Drucker, Sibel Asantugrul and Christine Bates, Committee Secretary.

Chair Pontbriand called the meeting to order at 7:00 pm.
7:00 pm 06-15 Harborside Village Cooperative Corporation, Harbor Lights Circle and Weatherly Ave, Map 20, Parcel 19: Application for a Special Permit under WZB 6.1.1 and 6.1.5 to replace 17 existing trailers with 17 new trailers set on piers, above base flood elevation and not in the Floodplain District. Attorney Myer Singer represented the applicants. He stated there is a condo association meeting scheduled for May 6, 2006 and the applicant would like to request a continuation until after that meeting. Jeffrey Stewart requested Mr. Singer supply the Board with Trailer Law history and the history of this trailer park. Jeffrey Stewart moved to continue the hearing to May 25, 2006; seconded by Trevor Pontbriand; passed 5-0.
7:10 pm 06-16 Lawrence and Karen Goldberg, 75 East Hill Rd, Map 29, Parcel 455: Application for a Special Permit under WZB 6.1.5.2b to construct a deck within the setback. Chet Lay of Slade Associates represented the applicant. Board members for this hearing were Trevor Pontbriand, Jeffrey Stewart, Bruce Drucker, Vern Jacob and Sibel Asantugrul. A site visit was made. Discussion took place regarding the location of the pool and the existing decking and if the application would be creating a new non-conformity. Chet Lay stated the new deck is at the level of the second floor. No elevation plans were available to the Board. Pontbriand moved to continue to May 11, 2006 so the applicant can provide adequate elevation plans as well as talk to
the Building Inspector regarding the current decking and pool; seconded by Bruce Drucker; passed 5-0.
7:20 pm 05-08 Mark and Mary Berry, 633 Route 6, Map 42, Parcel 72: Amend Special Permit to allow condominiums for year round use (Cont’d from 03/09/06). Attorney Ben Zehnder represented the applicant. Zehnder requested to wait until 7:30 pm to see if Board member Robert Hankey was going to make the meeting.
7:21 pm Meeting minutes of March 9, 2006 were reviewed and amended. Jeffrey Stewart moved to approve March 9, 2006 meeting minutes with amendments; seconded by Trevor Pontbriand; passed 5-0.
7:30 pm 05-08 Mark and Mary Berry: Attorney Zehnder requested a continuation on his client’s behalf based on the fact that the original five Board members for the Berry hearing were not present. Trevor Pontbriand moved to continue the hearing to April 27, 2006; seconded by Bruce Drucker; passed 4-0.
Trevor Pontbriand moved to adjourn the meeting at 7:35; seconded by Jeffrey Stewart; passed 5-0.
